Boreal Lending is a referral and matching service. It is not a lender, bank, or credit broker, and it does not make credit decisions. Please read these Terms carefully before using our service.

1. Acceptance of Terms

By accessing or using the Boreal Lending website, forms, or services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and Boreal Lending.

2. What Boreal Lending Is

Boreal Lending is a referral and matching service that connects users with third-party lenders and lending partners who may be able to offer financing options. Boreal Lending is not a lender, bank, credit union, or credit broker. We do not make any credit decisions, do not issue loans, and do not set the terms, rates, or amounts of any financing.

Boreal Lending is not affiliated with, endorsed by, or connected to any government agency, credit bureau, or regulatory body. Any financing offer you may receive comes solely from an independent third-party lender.

3. Eligibility

To use the Service, you must:

Be at least 18 years of age, or the age of majority in your province or territory of residence, whichever is greater;
Be a resident of Canada;
Have the legal capacity to enter into a binding agreement.

By using the Service, you represent and warrant that you meet these eligibility requirements.

4. No Guarantee

Boreal Lending makes no guarantee of any approval, loan amount, interest rate, funding, or any other outcome. Being matched with a lender does not mean you will be approved for financing. Any offer you may receive comes from a third-party lender and is subject to that lender's own terms, evaluation, and approval process.

Submitting a request through the Service is not a loan application with Boreal Lending. Boreal Lending simply forwards your request to its partner network to look for a possible financing option.

5. Consent to Be Contacted

By submitting a request through the Service, you consent to be contacted by Boreal Lending, its partner, and its lender network by phone, email, and SMS/text message (including through automated dialing systems, pre-recorded messages, and automated text messages) regarding your request, even if your number is listed on a Do Not Call registry.

Consent is not a condition of any purchase or financing. You may withdraw your consent at any time by contacting us at info@boreallending.ca, by replying STOP to a text message, or by using the unsubscribe link in any email.

6. Information Sharing

To provide the Service, the information you submit is shared with our partner network of lenders and service providers so they can look for a financing option that may suit your request. For details on how your information is collected, used, and shared, please review our Privacy Policy.

7. Checking Options and Your Credit Score

Simply checking your options through Boreal Lending does not affect your credit score. Any preliminary matching is a soft process that does not create a hard inquiry on your credit report. If a hard credit inquiry is ever performed, it would be conducted by a third-party lender, only with your consent, as part of that lender's own application process.

8. User Responsibilities

You agree to provide accurate, current, and complete information when using the Service. You are solely responsible for the accuracy of the information you submit. Providing false, misleading, or incomplete information may result in the inability to match you with a suitable lender and may disqualify you from any financing offer.

9. Intellectual Property

All content on the Service, including text, graphics, logos, images, layouts, and software, is the property of Boreal Lending or its licensors and is protected by Canadian and international intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written permission.

10. Third-Party Sites and Links

The Service may contain links to, or redirect you to, websites operated by third-party lenders and partners. Boreal Lending does not control and is not responsible for the content, products, services, privacy practices, or terms of any third-party website. Your interactions with any third-party lender are solely between you and that lender. We encourage you to review the terms and privacy policies of any third party before providing them with information.

11. Disclaimer of Warranties and Limitation of Liability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Boreal Lending does not warrant that the Service will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Boreal Lending and its officers, directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service, any financing you may or may not obtain, or the acts or omissions of any third-party lender, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless Boreal Lending and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Changes to the Terms

Boreal Lending reserves the right to modify or update these Terms at any time, at its sole discretion. Any changes will be posted on this page with an updated effective date. Your continued use of the Service after any changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in the Province of Ontario for the resolution of any dispute arising out of these Terms or the Service.
